April 29th, 2002 Despite Friday’s Supreme Court decision that the Radiocommunications Act constitutes a total prohibition of encrypted signals from foreign broadcasters, the battle to safeguard our right to such signals is not over yet. It is still business as usual for us until this fight has reached its conclusion. We will be asking the Supreme Court of British Columbia to set aside the decision until such time as the Supreme Court of Canada rules on the validity of the law when measured against section 2(b) of the Charter of Rights that protects Canadians’ freedom of expression. The Supreme Court of Canada acknowledged in its ruling that a Charter challenge is expected. A successful challenge will result in the current Act to be thrown out and replaced by a new one that reflects the rights of Canadians.
