H1Bでアメリカ滞在中ですが、9月に日本に帰国する可能性大のものです。あるコンサルタントが「1年以上滞在していればバッファローで申請できる。日本に帰る前にバッファローに申請した方が良い」とアドバイスをしてくれたのですが、皆さんの投稿の中に「申請時に1年以上ビザが残っていればバッファロー申請ができる」とあったので、混乱しています。私のビザは9月で切れるので、当然1年以上は残っていません。たとえバッファローに申請しても、日本に帰国した時点でマニラに転送されてしまうので、日本からマニラに申請しても同じことでしょうか？

移民局のページにこんな風にかいてありました。
providedというのは、仮定法のIFの強調だと思うのですが、、、、。
私の周りにも、これは「残存期間１年」という人と「１年滞在してれば」という人がいます。どうなんでしょうね。
Determine which Canadian visa office is responsible for:

* the country in which you are residing, provided you have been lawfully admitted to that country for at least one year; or
* your country of nationality.




　

I applied to Baffalo as a skilled worker before. At that moment, my work permit had only 3 months left. In fact, I had the same question you have but I just tried. Also, I atteched a letter in which I mentioned I was gonna extend my work permit. (However, unexpectedlly, I could not extend my work permit...:((()
Many friends told me that I took a risk....because it depends on officer. Some officer might send your application to Philippin. Fortunately, my application were accepted. Now, it is in process. Well, but still I am just telling my case though. Good luck!

結局、ビザの残存期間が１年以上残ってないといけないのが本当なのですね。
