We have reviewed the document you sent us.
We appreciate the feedback you have given us explaining what you think should be A社 responsibility and what should be our responsibility.
Respectfully, we disagree with your position and still believe that the entire $69,912.75 should be the responsibility of A社, especially since we were only reimbursed by our customer for exactly the amount we paid to A社 for the tools and had no margin.
This leaves us, unfortunately, at a bit of an impasse.
At this point, we believe the best compromise solution would be for A社 to ship the backup tools currently ready in Japan to Canada so that we are in possession of the backup tools as per our customer requirements.
The money we believe we are owed by A社 is considerably greater than the amount still owing on these backup tools. We would be willing to write off the balance due to us from A社 for issues with these tools in exchange for the tools being transferred to us free of any liens or encumbrances. We would not issue any further payment to A社 for these tools. This would close the transactions between us on this program.
We believe this represents a reasonable compromise given the
circumstances, and would look forward to the opportunity to work with you again on future programs where we can hopefully both learn from what has happened with these tools and ensure that past mistakes are not repeated by either company.
Please advise if you would be willing to accept this compromise.
