This line is from a Swiffer commercial, but it doesn’t
seem to make sense to me.
Shouldn’t it be, "Can you point to the offender,"
or something like that? Clarify this for me.

What I means is that you can’t ask a witness to
point to the defendant because a defandant is already
defined in the court. You have to ask the witness to
point to who or whatever was the perpetuator in the
crime. Do you get my point?

Isn’t it the whole point of this ad? It just makes fun of the courtroom drama. Many commercial ads are stupid like this one.
People knows the phrase is funny in the court because everybody knows who is the defendant.
A real judge would never make such a stupid question. However he did ask the question and she did point to the mop when the lawyer shouts "Objection!" all with serious faces, like dramatic courtroom drama. Nothing makes sense, that is the point.
Can you get that it is a parody of a courtroom drama. In parody, concversation have to be stupid as this.
Don’t take it seriously. It’s an ad, and they always try to make people laugh.

Oh, I get what you mean. And I get res5’s point, too. I know, it’s all stupid. But yes, I think in court, they have to double check everything, so when you ask witness some questions, you have to ask the witness who she/he is actually talking about. It’s all drama.
